If you've ever done it, or even just thought about it out of curiosity or jealousy, you should now know that checking your partner's WhatsApp messages is a criminal offense.

This has been officially confirmed by the Italian Supreme Court, which considers the application a legally protected information system.

Case in point: The man who spied on his ex-wife

The case that was heard by the court concerned a man who, during divorce proceedings with his ex-wife, had extracted WhatsApp conversations to use as evidence in court. He had accessed the phone and taken screenshots of sensitive information.

According to the court's decision, the man violated privacy and illegally accessed a password-protected system, committing a criminal offense.

The court emphasizes that WhatsApp is an information system in the legal sense, as through its software it interacts with computer networks and stores user data in a protected manner.

This means that unauthorized access to it, even by a person who knows the password, constitutes a legal violation – even if the device is temporarily in their possession.

Even with permission, misuse is punishable.

Even in cases where the owner of the device grants permission for use, if that permission is misused to access unauthorized conversations or information, the person responsible still faces criminal consequences.

Penalties: Up to 10 years in prison

For these cases, the Italian Criminal Code provides for penalties of up to 10 years in prison, considering access to a protected information system as a serious violation of privacy and personal security.
